The following terms and conditions set out the basis on which you agree to use our products and this website. Your use of our products will be taken as agreement with the below terms and conditions.

A. General

References to “we”, “us”, “our” and AER Marketing shall apply to AER MARCOM LIMITED.

When we refer to our “Products” we are referring to, inter alia: solutions; frameworks; tools, guides and training materials pertaining to Marketing Programmes & Services, Website Development, and our Membership offering delivered via our online membership platform.

B. Use of Product

No element of these products may be reproduced, edited, copied or otherwise amended without our prior express consent. The commercial use of any content taken from this website is expressly forbidden unless otherwise agreed in writing by us.

C. Intellectual Property

These products are the property of AER MARCOM LIMITED. Save where otherwise cited or indicated, all content and materials published is our property or the property of our suppliers and/or licensors and is protected by applicable copyright and/or other intellectual property laws.

No content from these products may be shared, copied, altered or reproduced without the prior consent of the Company.

We are not responsible for the content or privacy practices of any referenced third party companies. Any third party companies are clearly identifiable as such.

Where you purchase any of our products you are purchasing a licence to use our products in accordance with the specific parameters of said licence. You do not gain the right to share or distribute our products with third parties without the prior consent of AER MARCOM LIMITED.

D. Limitation of Liability

We accept no liability for the conduct of product users.

Customers are responsible for checking whether any taxes or charges are payable on their purchase of any of our Products and we offer no warranties as to whether taxes are payable on same.

The content outlined on these products is intended for general information purposes only. It is not the intention of AER MARCOM LIMITED nor any of their employees, officers or members that such information be used as professional or legal advice.

The Company accepts no liability for any loss or damage howsoever arising as a result of use of, or reliance on, this information, whether authorised or not.

The Company accepts no liability for the accuracy of content of third parties which may be published in these products from time to time or referenced by our Products & materials.

Except as expressly set out in these terms and conditions, all representations, warranties, terms and conditions whether express or implied in relation to these products or the information contained herein, are hereby excluded to the fullest extent permitted by law.

The products, courses, publications and educational materials published by the Company are subject to amendments periodically. The Company reserves the right to amend such materials at any time without notice.

E. Login for Additional Services

You may be required to use a password in certain circumstances for access to our Products. You agree to maintain the security of the chosen password for access to same. Where you disclose your password to a third party you agree to accept liability for breaches of our intellectual property rights which may follow.

F. Payments for Products

Where we accept payment for our Products, you agree to accept liability for same, whether carried out by you or by another on your behalf.

Where you have reason to believe a transaction has been recorded incorrectly or an error has occurred you agree to contact us immediately to report same.

You should check your statements and records carefully. If you believe a transaction is wrong or unauthorised, you should contact us immediately.

Due to the nature of our products, we are unable to provide refunds once a product has been downloaded or otherwise accessed by a customer. Please see Section I (Membership Terms) for the specific refund and cancellation policy applicable to our Membership.

G. Confidentiality

Our products are considered confidential and by accessing our products you are agreeing to maintain the confidentiality of same and to use our products in accordance with the terms on which they were sold only. For the avoidance of doubt customers are not entitled to share our products with any third parties without our prior express written permission.

H. Governing Law

All disputes arising out of or in any way relating to these Terms and Conditions or any other disputes in any way connected with the subject matter of these Terms and Conditions shall be governed by the laws of Ireland and subject to the exclusive jurisdiction of the Irish courts.

I. Membership Terms

This section governs your purchase of and access to the AER Marketing Membership (the “Membership”). In the event of any conflict between this section and the general terms above, this section shall take precedence in respect of the Membership.

I.1  The Membership

The Membership provides access to marketing resources, training materials, frameworks, and community features as described on our sales page at the time of your purchase. Membership content is delivered via our third-party platform provider, Podia (Podia Labs, Inc.). Your use of that platform is also subject to Podia’s own terms of service, available at podia.com/terms.

I.2  Personal Use Only

Your Membership is for your personal use only. You may not:

  • Share your login credentials with any other person.
  • Allow any third party to access Membership content using your account.
  • Record, screenshot, download, redistribute, or share any Membership content in any format.
  • Use Membership content for any commercial purpose without our prior written consent.

Any breach of this clause may result in immediate termination of your Membership without refund, and we reserve the right to pursue any further remedies available to us under law.

I.3  Subscription & Billing

The Membership is offered on a recurring subscription basis. You may choose from the following billing options at the time of purchase:

  • Monthly subscription — billed every calendar month from the date of your initial payment.
  • Annual subscription — billed once per year from the date of your initial payment.

Your subscription will renew automatically at the end of each billing period at the then-current rate unless you cancel before the renewal date. We will use reasonable efforts to notify you of any change in price before your next renewal.

Payment is processed via our third-party payment processor. By purchasing a Membership you authorise recurring charges to your chosen payment method until you cancel.

I.4  Cancellation

You may cancel your Membership at any time by managing your account settings within the membership platform or by contacting us at the email address below.

Upon cancellation:

  • Your Membership will remain active until the end of your current paid billing period.
  • You will not be charged for any subsequent billing periods.
  • Access to Membership content will cease at the end of the paid period.
  • No partial-period refunds will be issued for the remaining days of a billing period, except where required by law (see Section I.4 below).

I.5  Refund Policy

We offer a 14-day money-back guarantee on all Membership purchases. If you are not satisfied with your Membership for any reason, contact us within 14 days of your initial payment and we will issue a full refund, no questions asked.

To request a refund, email us at admin@aermarketing.ie with the subject line “Membership Refund”. We will process your refund within 14 days of receiving your request using the same payment method as your original purchase.

The 14-day refund period applies to your initial purchase only. Subsequent renewal payments are non-refundable, though you may cancel at any time to prevent future charges (see Section I.4).

If you believe an error has been made in billing at any time, please contact us immediately and we will investigate.

I.6  Changes to the Membership

We reserve the right to update, modify, or discontinue any Membership content, features, or pricing at any time. Where we make a material change to the Membership or its pricing, we will provide reasonable notice by email before your next renewal. Your continued subscription after such notice constitutes acceptance of the change. If you do not wish to accept a material change, you may cancel before your next renewal date.

I.7  Third-Party Platform

Membership content is hosted and delivered via Podia. We are not responsible for any interruptions, outages, or errors attributable to the Podia platform. You may need to create a Podia account and accept Podia’s terms of service to access Membership content.

J. Updates to These Terms

We will post any changes to these terms and conditions on our website and when doing so will change the “Last Updated” date at the top of this page.
